then I would check that the permissions on the "oracle" binary. change
directory to ORACLE_HOME/bin

cd $ORACLE_HOME/bin
ls -l oracle

mine looks like:

-rwsr-s--x 1 oracle oinstall 108852921 2006-10-02 09:09 oracle*
